Terms of Service

These Terms of Service form a binding agreement between you and the developer of MedAtlas. Please read them carefully. By downloading, installing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility and acceptable use

MedAtlas is intended exclusively for use by licensed healthcare professionals and by trainees acting under appropriate supervision (collectively, "Authorized Users"). By using the App you represent and warrant that you are an Authorized User and that your use complies with all laws, regulations, and professional standards applicable to your practice and your jurisdiction.

You are responsible for the security of the device on which you use the App and for any actions taken under your device or your Apple ID. You agree not to use the App in any manner that interferes with its operation, attempts to gain unauthorized access to any system or data, violates any law or regulation, or infringes the rights of any third party.

2. License grant

Subject to your continued compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices you own or control, solely for your own internal reference in the course of your professional work.

This license does not give you any ownership interest in the App or its contents. All intellectual property rights in the App, including the source code, design, text, graphics, audio, and clinical content (other than third-party content properly attributed within the App), are owned by us or our licensors.

3. Restrictions

You agree not to, and not to allow any third party to: (a) sell, lease, license, sublicense, distribute, or otherwise commercially exploit the App or its content; (b) reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent such restriction is prohibited by law; (c) modify or create derivative works based on the App; (d) scrape, harvest, or systematically extract content from the App; (e) use the App in a manner intended to defame, harass, or harm any person; (f) input or transmit any patient health information ("PHI") through the App; or (g) circumvent or attempt to circumvent any usage restriction, paywall, or security mechanism in the App.

4. Subscriptions and billing

MedAtlas offers a free tier and a paid subscription called "MedAtlas Pro" that unlocks additional content. The free tier is available indefinitely without payment.

Trial period. MedAtlas Pro may be offered with a 7-day free trial introductory period for first-time eligible Apple ID accounts. Eligibility is determined by Apple. If your free trial begins, you will not be charged until the trial period ends, unless you cancel.

Auto-renewal. Subscriptions to MedAtlas Pro are auto-renewing. Payment will be charged to your Apple ID account at confirmation of purchase or, if you started a free trial, at the end of the trial period. The subscription automatically renews at the end of each billing period (monthly or annual, depending on the plan you selected) unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the then-current renewal price.

Managing your subscription. You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings (Settings → [your name] → Subscriptions). Cancelling auto-renewal does not entitle you to a refund for the current billing period; you will retain access to MedAtlas Pro until the end of the period you have already paid for.

Refunds. All purchases are processed by Apple, and all refund requests must be submitted to Apple through https://reportaproblem.apple.com. We do not have the ability to issue or deny refunds on Apple's behalf, but we will assist where we can. EU consumers retain any statutory withdrawal rights that apply under their local law.

Price changes. We may change subscription prices from time to time. Any change will apply to subsequent renewal periods and will be communicated to you in advance, where required by Apple and by applicable law.

5. Free tier vs. Pro

The free tier of MedAtlas includes all 251 calculators and a curated set of approximately 100 high-frequency reference items across the other content categories. The Pro tier adds the remaining reference content (additional syndromes, drugs, protocols, procedures, and algorithms), along with future content updates released during your subscription.

We reserve the right to adjust which items are included in the free tier from time to time as the content library evolves. We will not, however, remove access to a feature or item you have paid for during your current billing period.

6. Content sources and accuracy

MedAtlas summarizes guidance published by professional societies, regulatory agencies, and peer-reviewed sources. Each treatment regimen, calculator, and decision pathway is linked to a citation visible within the App.

We make reasonable efforts to keep this content current, but we cannot guarantee that any individual entry reflects the most recent literature or local protocol. You are solely responsible for verifying any clinical decision against authoritative current references before acting on it.

7. No medical advice

MedAtlas is a reference tool. It is not a substitute for professional medical judgment, examination, diagnosis, or treatment of any patient. Nothing in the App creates a doctor-patient, advisor-client, or other professional relationship between you and us. See the Medical Disclaimer for additional important limitations of use.

8. Disclaimer of warranties

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, USE, OR DATA; OR FOR ANY DAMAGES ARISING OUT OF OR RELATING TO PATIENT CARE OR CLINICAL OUTCOMES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU HAVE PAID FOR THE APP IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless the developer of MedAtlas and our officers, directors, employees, contractors, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your violation of any law or the rights of a third party; (c) your use of the App, including any clinical decision made in connection with your use; or (d) any content you enter or transmit through the App.

11. Privacy

Our handling of any data processed through the App is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy carefully — it explains what limited information we collect (which does not include personally identifying information) and how that information is used.

12. Termination

You may stop using the App and cancel any subscription at any time. We may suspend or terminate your access to the App if you violate these Terms or if we discontinue the App. If we discontinue the App while you have an active paid subscription, we will pro-rate any unused portion of your current billing period and assist in obtaining a refund through Apple. Sections 3, 6, 7, 8, 9, 10, 13, 14, and 15 survive termination.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App that is not resolved by good-faith negotiation will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you and we consent to the personal jurisdiction of those courts.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction that grants you mandatory consumer-protection rights, nothing in this Section limits those rights, and you may bring an action in your country of residence to the extent the law of that country requires.

14. Apple-specific terms

The following additional terms apply when you obtain the App from the Apple App Store:

Apple is not a party to these Terms. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

Maintenance and support. We are solely responsible for any maintenance and support of the App. Apple has no obligation whatsoever to provide maintenance or support.

Warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Product claims. We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property. In the event of any third-party claim that the App or your use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

15. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy and the Medical Disclaimer, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce that provision later.

Assignment. You may not assign these Terms. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Notices. We may give notices through the App or to any email address you provide us. You may give notice to us at support@usemedatlas.com.

Changes. We may update these Terms from time to time. Material changes will be communicated through the App. Your continued use of the App after a change indicates acceptance of the revised Terms.
